Harness trainer cleared

Harness Racing Victoria (HRV) stewards on Monday concluded an inquiry into an elevated TC02 level returned by the Aaron Brown-trained Jayares Lad following its win at Ararat on June 16, 2008.

The inquiry was opened following analysis of a pre-race blood sample by Racing Analytical Services Ltd (RASL), which indicated the elevated reading.

Evidence was taken at the inquiry from Mr Brown, Dr John Vine - RASL Laboratory Director and Mr Andy Rogers - HRV Investigative Steward.

The analysis reported by RASL indicated a TC02 level of 37.5 mmol/L which is above the legal allowable level of 36.0 mmol/L, but is subject to an uncertainty of + or - 1.0 mmol/L.

The reserve sample, which was analysed by the Racing Science Centre (Queensland), reported a level of 35.9 mmol/L which is also subject to an uncertainty of + or - 1.0 mmol/L.

The evidence indicated that a variance of some 1.6 mmol/L was apparent between the analyses of the two laboratories. The analysis undertaken and reported by RASL exceeded the allowable threshold for TCO2 and may be considered prima facie evidence that a breach had occurred under the rules.

However, in view of the significant variance with the RSC analysis, which reported a level under the allowable threshold, the panel could not be satisfied to the required standard that an offence had been committed.

On this basis Mr Brown was afforded the benefit of the doubt and no action was taken.
